Further, your\nparent or legal guardian must agree to be bound by these Rules on your behalf.\nIf the Sponsor discovers that parental consent was not obtained, the entry will\nbe void. Because entrants are under the age of majority in their province or\nterritory of residence, prizes won by entrants will be awarded to the parent or\nlegal guardian on behalf of the entrant. This Contest is not open to employees,\nrepresentatives, and agents of the Sponsor, their parents, related and\naffiliated companies, advertising and promotional agencies and the members of\nthe households of such employees, representatives and agents.<\/p>\n\n\n\n<p><strong>SECTION 2: CONTEST PERIOD:<\/strong><\/p>\n\n\n\n<p>The Contest starts at 10:00 am EDT on Monday, July 1st, 2024, and closes at 11:59 pm EDT on Wednesday, July 31st, 2024 (the \u201cContest Period\u201d). Any entries received after that time will be void. One (1) entry per person is permitted.<\/p>\n\n\n\n<p><strong>SECTION 3: HOW TO PARTICIPATE<\/strong><\/p>\n\n\n\n<p>In order to enter the Contest, the entrant must, with their parent\u2019s or guardian\u2019s knowledge and permission, produce a drawing, painting, or piece of art made with found forest materials, of a tree. The entrant must submit a photo of their art using the entry form available at <ins><a href=\"http:\/\/www.earthrangers.com\/EN\/CA\/holidaycardcontest\/\">http:\/\/www.earthrangers.com\/EN\/CA\/holidaycardcontest\/<\/a><\/ins>. Each entrant must follow the submission instructions available on the Contest webpage as listed above, confirming in the Contest entry form that they have read and agree with these Rules, and confirming that they, the entrant, are under the age of majority in the entrant\u2019s province or territory of residence. In the Contest entry form, the entrant\u2019s parent or legal guardian must also give permission for the entrant to enter the contest, agree to the Rules, and agree that all the information provided in the entry form was filled out by a parent or legal guardian by choosing \u201cConfirmed\u201d in the dropdown menu on the Holiday Card Contest entry form.<\/p>\n\n\n\n<p>After satisfying the above eligibility requirements, the entrant\nwill be entered into the Contest during the Contest Period. One entry per\nentrant will be permitted. If an entrant submits multiple entries, only the\nmost recent entry will be considered.<\/p>\n\n\n\n<p>By entering the Contest, entrants\u2019 parents or legal guardian\nagree to abide by these Rules, which shall be final and binding on all entrants\nin all matters relating to this Contest.<\/p>\n\n\n\n<p>Sponsor is not responsible for lost, incomplete, or misdirected\nentries, or entries that are processed late or incorrectly or are lost due to\ncomputer or electronic malfunction or other error.<\/p>\n\n\n\n<p><strong>SECTION 4: PRIZE<\/strong><\/p>\n\n\n\n<p>Prize: There are three (3) prizes (each, a \u201cPrize\u201d) available to\nbe won.<\/p>\n\n\n\n<p>1st Prize:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Feature on the FPAC Christmas card<\/li>\n\n\n\n<li><ins>Gift pack containing a set of Paint by Numbers Kit with Beam paints (Inaandek Colors) and paintbrush, Native Northwest cedar pencil and bookmark, toque, notebook, tote bag, $25 Indigo gift card<\/ins>. <ins>MRSP $50.00 per pack<\/ins>.<\/li>\n<\/ul>\n\n\n\n<p>2<sup>nd<\/sup> and 3<sup>rd<\/sup> Prize:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><ins>Gift pack containing a set of Paint by Numbers Kit with Beam paints (Inaandek Colors) and paintbrush, Native Northwest cedar pencil and bookmark, toque, notebook, tote bag, $25 Indigo gift card.<\/ins> <ins>MRSP $50.00 per pack<\/ins>.<\/li>\n<\/ul>\n\n\n\n<p>The chances of winning a Prize depends upon the weighted\ncriteria of the Judging panel and the total number of eligible entries received\nin the Contest Period. The Prize may not be exchanged for cash, is\nnon-transferable, non-refundable, non-salable, and must be accepted as awarded.<\/p>\n\n\n\n<p>The Sponsor reserves the right to make any changes to the Prizes\nfor any reason and without notice, and any difference between the actual value\nof the Prize and the approximate value of the Prize as stated in these Rules\nwill not be awarded. The winner is solely responsible for all other costs not\nspecifically identified as included in the Prize.<\/p>\n\n\n\n<p>The Sponsor is not responsible for the forfeiture of the Prize\ndue to changes in mailing addresses, or any other circumstances resulting in an\ninvalid, erroneous or incomplete mailing address or e-mail address.<\/p>\n\n\n\n<p><strong>SECTION 5: SPONSOR JUDGING TO DETERMINE WINNERS<\/strong><\/p>\n\n\n\n<p>Winners will be determined solely by the decisions of a panel of\njudges appointed by the Sponsor (the \u201cJudging Panel\u201d) on the basis of the\nfollowing weighted criteria: (a) aesthetic quality of the painting, drawing, or\nart piece produced (50%); and (b) creativity of the painting, drawing, or art\npiece (50%). Eligible entries will be reviewed by the Judging Panel and ranked based\non the weighted criteria above. If two or more finalist entries have the same\nhighest ranking score, a random draw will be held between these two or more\nfinalist entries to select the Grand Prize winner.<\/p>\n\n\n\n<p><strong>SECTION 6: PRIZE CLAIM CONDITIONS<\/strong><\/p>\n\n\n\n<p>The Sponsor will contact the selected winners within seventy-two\n(72) hours of the conclusion of the Judging Panel\u2019s final selection by email at\nthe email address provided in the Contest entry form and the selected winner\nmust respond to the notification within three (3) business days of the first\nattempt by Sponsor. Failure to respond by such time may result in the forfeiture\nof the Prize in the absolute discretion of the Sponsor.<\/p>\n\n\n\n<p>To be confirmed as the winner of the Contest, the selected\nwinner must be in full compliance with these rules; and, the selected winner\u2019s\nparent or legal guardian must sign and return a release of liability and\nconsent to publicity form (the \u201cRelease Form\u201d) and any other documentation as\nmay reasonably be required by the Sponsor in their absolute discretion. If two\nor more finalist entries receive the same highest ranking score by the Judging\nPanel and a random draw is held between these two or more finalist entries to\nselect the Grand Prize winner, the selected Grand Prize winner must correctly\nanswer, without assistance of any kind, whether mechanical or otherwise, a\ntime-limited, mathematical skill-testing question to be confirmed as the Grand\nPrize winner of the Contest.<\/p>\n\n\n\n<p>Decisions and rulings of the Sponsor are final and binding\nwithout appeal in all matters related to this Contest and the awarding of a\nprize.<\/p>\n\n\n\n<p>A selected winner and their parent and legal guardian may be\nrequired to provide proof of identification to the Sponsor when claiming the\nPrize or otherwise in connection with this Contest to facilitate the Sponsors\u2019\naccurate identification of a Contest winner.<\/p>\n\n\n\n<p>If the selected entrant has met the eligibility requirements set\nout in these Rules, the selected entrant will be confirmed as the Prize winner.<\/p>\n\n\n\n<p>If a selected winner does not fulfill the conditions set out in\nthese Rules, or declines or forfeits the Prize, the Sponsor reserves the right,\nin their absolute discretion, to cancel the Prize or to select another entrant.\nAny alternate winner(s) will be selected by the same judging and ranking\nprocess from the remaining eligible entries in the same manner as described\nabove.<\/p>\n\n\n\n<p>Entrants who have not complied with these Rules will be\ndisqualified.<\/p>\n\n\n\n<p><strong>SECTION 7: INTELLECTUAL PROPERTY<\/strong><\/p>\n\n\n\n<p>By submitting your contest entry form and any related material,\nyou waive all moral rights and grant (or warrant that the owner of such\nmaterials expressly grants) to the Sponsor, its parent, related and affiliated\ncompanies, and subsidiaries, a worldwide, perpetual, royalty-free, irrevocable,\nsub-licensable, and non-exclusive license and right to (i) use, copy, adapt,\ntransmit, communication, publicly display, perform, and\/or distribute such\nsubmitted materials; and (ii) create compilations and\/or derivative works from\nsuch submitted materials.<\/p>\n\n\n\n<p><strong>SECTION 8: GENERAL CONDITIONS<\/strong><\/p>\n\n\n\n<p>All Contest entries will become the property of the Sponsor and\nwill not be acknowledged or returned.<\/p>\n\n\n\n<p>The selected entrant will be disqualified and required to\nforfeit any claim to a Prize if the terms set forth in these Rules are not\nadhered to.<\/p>\n\n\n\n<p>By participating in this Contest, entrants\u2019 parents or legal\nguardians acknowledge compliance with, and agree to be bound by, these Rules,\nincluding the eligibility requirements. Further, entrants\u2019 parents or legal\nguardians release and hold harmless the Sponsor, its parent, related and\naffiliated companies, subsidiaries, advertising and promotional agencies and\neach of their respective directors, successors, sponsors, partners, licensees,\nofficers, subsidiaries, agents, employees, advisors, assignees, prize\nsuppliers, and all others associated with the development and execution of the\nContest (collectively, the \u201cReleasees\u201d), from and against any and all manner of\naction, causes of action, suits, debts, covenants, contracts, claims and\ndemands, including legal fees and expenses, whatsoever, including but not\nlimited to, claims based on negligence, breach of contract and fundamental\nbreach and liability for physical injury, death, or property damage which the\nentrant or his\/her administrators, heirs, successors or assigns might have or\ncould have, by reason of or arising out of the entrant\u2019s participation in the Contest\nand\/or in connection with the acceptance and\/or use by the entrant of the\nPrize. Without limiting the foregoing, the Releasees shall not be responsible\nfor: (a) any incomplete or inaccurate information; (b) the theft, destruction,\nloss or unauthorized access to, or alteration of, entries; (c) printing,\ndistribution, programming or production errors, and any other errors of any\nkind, whether human, mechanical, electronic or otherwise; or (d) technical,\npictorial, typographical or editorial errors or omissions contained herein or\nin other materials related to the Contest.<\/p>\n\n\n\n<p>No responsibility will be taken by the Sponsor for the entrant\u2019s\ninability to connect to the Internet or website during the Contest Period,\nlost, delayed, mutilated or misdirected entries, computer system failure,\nfailure of the website during the Contest Period or for any problems or\ntechnical malfunction of a telephone network or lines, computer on-line\nsystems, servers, access providers, computer equipment, software, failure of\nany e-mail, online, or Internet entry to be received by the Sponsor on account\nof technical problems or traffic congestion on the Internet or at any website,\nor any combination thereof including any injury or damage to an entrant\u2019s or\nany other person\u2019s computer or property related to or resulting from\nparticipating in, or downloading any material relating to, the Contest. The\nSponsor reserves the right, in its sole discretion to cancel or suspend this\nContest without notice should a virus, bug or any other cause beyond the\nreasonable control of the Sponsor corrupt the security or proper administration\nof the Contest and to award the Prizes from among all eligible entries received\nprior to cancellation of the Contest. If, as a result of an error relating to\nthe entry process, judging, drawing or any other aspect of this Contest there\nare more potential winners of Prizes than contemplated in these Rules, there\nwill be a random draw among all eligible potential winners at the end of the\nContest Period to award the correct number of Prizes. The Sponsor reserves the\nright to disqualify any persons found attempting to deliberately damage any\nwebsite or application or undermining the legitimate operation of this Contest\nand seek remedies and damages to the fullest extent permitted by law, including\ncriminal prosecution. Entries are subject to verification by the Sponsor and\nwill be declared invalid if they are forged, falsified, altered or tampered\nwith in any way. The Sponsor reserves the right to cancel or suspend this Contest\nor to amend these Rules without notice for any reason whatsoever.<\/p>\n\n\n\n<p>The Sponsor reserves the right to terminate, suspend or modify\nthis Contest, in whole or in part, at any time and without notice or obligation\nif, in the Sponsor\u2019s sole opinion, any factor interferes with its proper\nconduct as contemplated by these Rules. Without limiting the generality of the\nforegoing, if the Contest, or any part thereof, is not capable of running as\nplanned for any reason which, in the sole opinion of the Sponsor, corrupt or\naffect the administration, security, fairness, integrity or proper conduct of\nthis Contest, the Sponsor may terminate, modify or suspend the Contest, or any\nportion thereof in its sole discretion.<\/p>\n\n\n\n<p><strong>SECTION 9: PRIVACY AND PERSONAL INFORMATION<\/strong><\/p>\n\n\n\n<p>By entering the Contest, each entrant and their parent or legal\nguardian consents (a) to the collection, use, and disclosure of the entrants\u2019\npersonal information, including the entrant\u2019s first name, province or territory\nof residence, image on videotape and\/or photograph in any advertising relating\nto the Contest and\/or the Prizes, and in any future publicity in connection\nwith the Contest and the Sponsor\u2019s related fundraising activities, in all media\nused by the Sponsor, and its advertising and promotional agencies and partners,\nwithout compensation or further notice, if that entrant is declared a Prize\nwinner, and (b) to the use of that entrant\u2019s personal information, including\nfirst name and address (such as e-mail address) for the purpose of\nadministering the Contest, contacting selected entrants, awarding and\ndelivering the Prizes to the winners and sending information relating to Earth\nRangers products, promotions and\/or other marketing activities.<\/p>\n\n\n\n<p>By entering the Contest, each entrant and their parent or legal\nguardian acknowledges and consents that the entrant\u2019s personal information can\nbe transferred to the Sponsor\u2019s third party service providers for the purpose\nof administering the contest, and can be stored on servers located outside of\nCanada, which may be subject to foreign legislation which may differ from the\nlegislation of Canada with respect to disclosure of personal information to\ngovernment authorities.<\/p>\n\n\n\n<p>For further information about the Sponsor\u2019s privacy practices,\nplease see Sponsor\u2019s Privacy Policy at:&nbsp;<a href=\"http:\/\/www.earthrangers.com\/wildwire\/privacy-policy\/\">http:\/\/www.earthrangers.com\/wildwire\/privacy-policy\/<\/a><\/p>\n\n\n\n<p><strong>SECTION 10: APPLICABLE LAWS<br>\n<\/strong><br>\nThis Contest is subject to the laws of the Province of Ontario and the federal\nlaws of Canada applicable therein.
